These Terms of Service ("Terms") govern your access to and use of the website wcagrepair.com and all related products, features, and services (collectively, the "Service") operated by WCAG Repair ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

1.1 Free WCAG Scanner

WCAG Repair provides an automated accessibility scanning tool that analyzes publicly accessible websites for WCAG 2.1 Level AA conformance issues. The scanner evaluates factors including but not limited to color contrast, alt text, heading structure, ARIA attributes, form labels, keyboard navigation, link text, language attributes, and document structure. Free scan results include an overall accessibility grade, issue count and severity breakdown, and a preview of the top issues found.

1.2 Accessibility Remediation Guide (Paid)

We offer a paid, AI-generated accessibility remediation guide that provides detailed, platform-specific fix instructions based on your scan results. Guides are delivered as downloadable PDF documents and include copy-paste code fixes for every issue found, priority ranking by user impact, platform-specific instructions (WordPress, Shopify, React, and more), and effort estimates per fix. Guide content is generated using third-party artificial intelligence services and is tailored to your scanned website's detected platform and specific issues.

1.3 Complete Site Audit Bundle (Paid)

We offer a bundled product combining an accessibility remediation guide with a site health report (SSL, DNS, headers, performance) and a security remediation guide at a discounted rate. The bundle also includes an AI readiness assessment and cross-platform fix instructions.

1.4 Monthly Monitoring Subscription (Paid)

We offer a recurring subscription service that includes automated monthly re-scans of your website, accessibility score trend tracking over time via a progress dashboard, new issue alerts, and fix report credits. Subscription-specific terms are detailed in Section 5.

1.5 Agency Plans (Paid)

We offer agency-tier plans for organizations managing accessibility compliance across multiple client websites, including unlimited site scans, team dashboards, and white-label reporting. Agency plan terms may include additional agreements beyond these Terms.

1.6 Comparison and Informational Content

We publish comparison pages, pricing information, blog posts, and other editorial content. This content is provided for informational purposes only and may include comparisons to third-party products and services such as WAVE, Lighthouse, axe DevTools, and accessiBe. All trademarks referenced are the property of their respective owners.

2. Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

To purchase paid products or subscriptions, you must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

  • Scan websites you do not own or do not have explicit authorization to scan
  • Use the Service to conduct security testing, vulnerability scanning, or penetration testing beyond the features we explicitly provide
  • Attempt to overload, disrupt, or interfere with the Service or its underlying infrastructure
  • Circumvent or attempt to circumvent rate limits, access controls, or other protective measures
  • Use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable use or published rate limits
  • Scrape, harvest, or systematically download scan results, remediation guides, or any other content from the Service
  • Use scan results or remediation guides to harass, defame, or harm the owners of scanned websites
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Reproduce, redistribute, or commercially exploit scan results, remediation guides, or any content from the Service without our written permission, except as expressly permitted in Section 7
  • Share, resell, or redistribute paid products (guides, reports, or subscription content) to third parties
  • Use the Service in any way that violates applicable local, state, national, or international law
  • Provide false or misleading information in connection with your use of the Service, including fraudulent payment information
  • Attempt to access another user's purchases, scan results, or download links

We reserve the right to suspend or terminate your access to the Service at any time if we reasonably believe you are violating these Terms.

4. Rate Limits and Access

The free scanning service is subject to rate limiting to ensure fair access and prevent abuse. We reserve the right to:

  • Impose or modify rate limits at any time without prior notice
  • Temporarily or permanently block access from IP addresses that engage in abusive behavior
  • Restrict or suspend access to any part of the Service at our sole discretion
  • Prioritize paid service requests over free scan requests during periods of high demand

5. Accounts, Access, and Authentication

The Service does not require account creation for free scans. Scans are identified by unique URLs, and purchases are associated with the email address provided during checkout. You are responsible for maintaining the confidentiality of your download links and scan result URLs.

Certain paid features, including monitoring subscriptions and agency dashboards, may require email-based authentication. You are responsible for maintaining the security of any credentials or access links provided to you.

6. Paid Products, Subscriptions, and Billing

6.1 Pricing

Current pricing for all paid products and subscriptions is displayed on our Pricing page. All prices are in United States Dollars (USD). We reserve the right to change pricing at any time. Price changes will not affect purchases or active subscription billing periods that have already been confirmed.

6.2 Payment Processing

All payments are processed through Stripe, Inc., a third-party payment processor. By making a purchase, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your full credit card number, expiration date, or CVV on our servers. You are responsible for any applicable taxes, duties, or government-imposed fees associated with your purchase.

6.3 One-Time Purchases (Guides and Bundles)

Accessibility remediation guides, complete site audit bundles, and other one-time products are digital purchases. Upon successful payment, you will receive access to download your guide as a PDF and may also receive it by email. Delivery is typically immediate but may take up to several minutes while your guide is generated.

6.4 Subscriptions and Auto-Renewal

Monthly monitoring subscriptions automatically renew at the end of each billing period at the then-current rate unless cancelled before the renewal date. Each billing period, your allotted number of priority reports and fix report credits resets. Unused credits do not carry over between billing periods.

6.5 Cancellation

You may cancel a subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to subscription features until the end of the period you have already paid for. No prorated refunds are issued for partial billing periods.

6.6 Refund Policy

Because our paid products are digital goods generated specifically for your scanned website, all sales are generally final (see our Refund Policy for details). However, if you experience a technical issue that prevents delivery of your purchased product (e.g., guide generation failure, download error), or if the guide is substantially incomplete or defective, please contact us at support@wcagrepair.com within 14 days of purchase and we will either re-deliver the product or issue a full refund at our discretion.

For monitoring subscriptions, you may cancel at any time as described in Section 6.5. No partial refunds are provided for unused time within a billing period.

6.7 Failed Payments

If a subscription renewal payment fails, we may attempt to process the payment again. If payment cannot be collected after reasonable attempts, your subscription may be suspended or cancelled. We are not responsible for any consequences resulting from service interruption due to failed payments.

7. AI-Generated Content

Certain features of the Service, including remediation guides, diagnostic reports, and fix recommendations, use artificial intelligence technology provided by third-party services to generate content. You acknowledge and agree that:

  • AI-generated content is produced algorithmically and may contain errors, omissions, or inaccuracies
  • AI-generated recommendations are general guidance and do not constitute professional accessibility consulting, legal, or technical advice
  • You are solely responsible for reviewing, verifying, and testing any recommendations before implementing them on your website
  • We do not guarantee that implementing AI-generated recommendations will achieve full or partial WCAG conformance or protect you from legal claims
  • AI-generated content may vary between requests even for the same website, as underlying AI models and website states change over time
  • AI models have inherent limitations and cannot replicate the judgment of qualified accessibility professionals or users with disabilities

8. NOT LEGAL ADVICE — IMPORTANT DISCLAIMER

WCAG REPAIR IS A TECHNOLOGY SERVICE, NOT A LAW FIRM, AND DOES NOT PROVIDE LEGAL ADVICE.

Our Service provides technological assistance only. Scan results, remediation guides, and all other outputs are technical recommendations intended to help you identify and address potential accessibility issues on your website. They are not legal opinions, legal counsel, or guarantees of legal compliance of any kind.

You acknowledge and agree that:

  • No output from the Service constitutes legal advice, a legal opinion, or a guarantee of compliance with the Americans with Disabilities Act (ADA), Section 508, the European Accessibility Act (EAA), EN 301 549, the Accessibility for Ontarians with Disabilities Act (AODA), or any other applicable law, regulation, or standard
  • Web accessibility standards — including WCAG — are updated, revised, and reinterpreted on a regular basis by standards bodies, regulatory agencies, and courts. What constitutes compliance today may not constitute compliance tomorrow
  • Automated scanning tools (including the axe-core engine used by our Service) can only detect approximately 30–50% of all potential accessibility issues. Many accessibility requirements — including content comprehension, cognitive load, and assistive technology compatibility — can only be evaluated through manual testing with assistive technologies and by users with disabilities
  • AI-generated remediation recommendations are produced by machine learning models and may contain errors, omissions, inaccuracies, or recommendations that do not apply to your specific context
  • Achieving and maintaining full WCAG conformance requires ongoing human judgment, manual testing, user research, and professional expertise beyond what any automated tool can provide
  • A passing scan result or high accessibility grade does not mean your website is fully accessible or legally compliant. Likewise, a failing result does not necessarily mean you are in violation of any law
  • You should consult with a qualified accessibility consultant and/or legal professional for definitive guidance on your compliance obligations

We take every measure to stay at the forefront of evolving accessibility standards and best practices, but we make no guarantees that our Service reflects the most current version of any standard at any given time.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including its design, code, algorithms, text, graphics, logos, and all other content (collectively, "Our Content"), is owned by or licensed to WCAG Repair and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of Our Content without our prior written consent.

9.2 Free Scan Results

Free scan results are provided for your personal and internal business use. You may share scan results for websites you own or are authorized to manage. You may not resell, redistribute, or commercially exploit free scan results without our written permission.

9.3 Paid Products

Purchased remediation guides and reports are licensed to you for your personal and internal business use in connection with the specific website that was scanned. You may share purchased content with colleagues, developers, or contractors working on the scanned website. You may not resell, publicly distribute, or use purchased content to provide services to third parties for websites other than the one scanned.

9.4 User Content

By submitting URLs, email addresses, or other content to the Service, you represent that you have the right to do so. You retain ownership of any content you submit, but you grant us a limited, non-exclusive, worldwide license to process that content as necessary to provide the Service, including scanning the submitted URLs, generating reports, and delivering communications you have requested.

10. Scan Authorization and Responsibility

By submitting a URL for scanning, you represent and warrant that:

  • You own the website or have obtained explicit authorization from the website owner to perform the scan
  • The scan will not violate any agreement you have with the website owner or any applicable law
  • You understand that our scanner accesses publicly available pages of the submitted URL (up to 10 pages), which may be logged by the target website's server

We are not liable for any consequences arising from your decision to scan a website, including but not limited to claims by website owners, violations of computer access laws, or triggering of security systems on the target website.

11. Third-Party Services and Cross-Promotions

11.1 Third-Party Services

The Service integrates with or relies on third-party services, including but not limited to Stripe (payment processing), Anthropic (AI content generation), and various browser automation technologies. We are not responsible for the availability, accuracy, or performance of third-party services. Your use of third-party services is subject to their respective terms and policies.

11.2 Related Products

The Service may display recommendations, links, or promotions for related products and services, including but not limited to Abby SEO (search engine optimization scanning and remediation), SiteDialect (website localization and internationalization), AI-Signed (AI content transparency verification), and NewSiteLead (website analysis). These are separately operated services with their own terms of service and privacy policies. Your use of any linked third-party or affiliated service is governed by that service's own terms, not these Terms. We are not responsible for the content, functionality, or practices of linked services.

11.3 Outbound Links

The Service may contain links to external websites and resources. We do not control, endorse, or assume responsibility for any third-party content, products, or services. Accessing external links is at your own risk.

12. Data Retention and Deletion

Free scan results are retained for a limited period and may be automatically deleted. IP address logs used for rate limiting and abuse prevention are retained for 7 days. Purchased products (guides, reports) and subscription data are retained for the duration of your subscription plus a reasonable period thereafter for legal and accounting purposes.

13. Email Communications

If you provide your email address in connection with a purchase, subscription, scan result delivery, or voluntary submission, we may send you:

  • Transactional emails related to your purchase or subscription (e.g., receipts, guide delivery, scan completion alerts)
  • Service-related notifications (e.g., subscription renewal reminders, monitoring reports, new issue alerts)
  • Marketing communications about our services and related products

You may unsubscribe from non-transactional communications at any time using the unsubscribe link included in our emails. Unsubscribe requests are processed promptly and are permanent unless you re-subscribe. Transactional emails related to active purchases or subscriptions cannot be opted out of while the service is active.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

15. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Accuracy or completeness of scan results, AI-generated recommendations, remediation guides, accessibility grades, or any other content provided through the Service
  • Uninterrupted or error-free operation of the Service, including scan processing, guide generation, and subscription monitoring
  • Compatibility with all websites, platforms, configurations, or hosting environments
  • WCAG conformance — we do not warrant that scan results will identify every accessibility issue on your website, or that implementing our recommendations will result in full or partial WCAG conformance
  • Legal protection — we do not warrant that using the Service will protect you from ADA lawsuits, demand letters, regulatory action, or any other legal proceeding

All content provided through the Service, whether free or paid, including accessibility recommendations, security assessments, and remediation instructions, is provided as general informational guidance only and does not constitute professional accessibility, legal, or technical consulting advice. Scan results may not be exhaustive, may not detect all issues, and may not reflect the current state of the scanned website at the time you view them. You are solely responsible for evaluating the applicability of any recommendation to your specific situation and for testing changes before deploying them to production environments.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WCAG REPAIR, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, business opportunities, or website traffic
  • Damages arising from your reliance on scan results, accessibility grades, AI-generated content, remediation guides, or any other output of the Service
  • Damages resulting from implementing any recommendation provided by the Service
  • Damages arising from accessibility-related lawsuits, demand letters, settlements, judgments, regulatory fines, or other legal proceedings brought against you by any party
  • Damages arising from your failure to achieve or maintain conformance with WCAG, the ADA, Section 508, the EAA, or any other accessibility law, regulation, or standard
  • Damages arising from errors, omissions, or inaccuracies in AI-generated recommendations
  • Damages caused by changes to accessibility standards, laws, or regulations after the date of your scan or report
  • Damages resulting from unauthorized access to or alteration of your data
  • Damages arising from any interruption, suspension, or cessation of the Service
  • Damages arising from third-party service failures, including payment processing errors or AI service outages

FOR FREE SERVICES, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00). FOR PAID PRODUCTS AND SUBSCRIPTIONS, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE THAT YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF SCAN RESULTS AND REMEDIATION RECOMMENDATIONS, AND YOU AGREE THAT WCAG REPAIR SHALL NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENCES ARISING FROM YOUR RELIANCE ON THE SERVICE'S OUTPUTS.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

17. Indemnification

You agree to indemnify, defend, and hold harmless WCAG Repair, its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use or misuse of the Service, including both free and paid features
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your scanning of websites without proper authorization
  • Your implementation of any recommendations provided by the Service
  • Any accessibility-related claims brought against you by third parties
  • Any claim by a third party related to your use of the Service or content generated for you
  • Your use of purchased products in a manner that exceeds the license granted in Section 9.3

18. Termination

18.1 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without prior notice or liability. This includes the right to cancel active subscriptions if you violate these Terms. In the event we terminate your subscription for cause, no refund will be issued.

18.2 Termination by You

You may stop using the free Service at any time. For subscriptions, you may cancel as described in Section 6.5. Upon cancellation, your access continues through the end of the current billing period.

18.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately (or at the end of a paid billing period, as applicable). You retain access to previously downloaded guides and reports. Sections 7, 8, 9, 10, 15, 16, 17, 19, and 20 shall survive termination.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA), with the arbitration conducted in the State of Delaware. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

For disputes involving amounts under $10,000 USD, the arbitration shall be conducted solely on the basis of documents submitted to the arbitrator, unless the arbitrator determines that a hearing is necessary.

20. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and WCAG Repair regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign our rights and obligations without restriction.
  • No Agency: Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and WCAG Repair.
  • Force Majeure: We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, or third-party service failures.
  • Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.

21. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. For active subscribers, material changes to subscription terms will be communicated by email at least 14 days before they take effect. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel any active subscriptions.
